Freelancer Contract
The agreement is concluded between ServiceHelper and Freelancer. The agreement regulates the ongoing cooperation
between the parties to the extent that Freelancer undertakes tasks via ServiceHelper’s platform. The agreement is
about ServiceHelpers expectations of the Freelancer and the quality of the services the Freelancer offers through
the platform.
§ 1. ServiceHelpers online platform
§ 1.1 Service Helper offers an online platform that communicates gardening and related
tasks between a Freelancer and customers who use the platform.
§ 1.2 A Freelancer creates a profile on the platform and goes through an approval
process.
If the Freelancer is approved, the Freelancer can start offering his services through our platform.
§ 1.3 Since Service Helper is not an employer of Freelancer, but merely mediates contact
between customers and Freelancer, we cannot instruct or impose requirements on how the service is performed.
However, ServiceHelper may well exclude Freelancer from the platform, based on our own requirements as to how
Freelancer are expected to handle tasks.
§ 1.4 When a task is arranged via Service Helper, the chosen Freelancer bears
responsibility to the user who requested service and must independently coordinates the types of tasks to be
solved,
when and how.
§ 2. Collaboration between Freelancer and Service Helper
§ 2.1 Freelancer must apply for permission to register on the platform. All information
provided when creating the profile must be correct and true.
§ 2.2 Freelancers are required to update their profile so that the profile at all times
reflects the real circumstances.
§ 2.3 Freelancer must answer any request from customers and users of the platform within
a
maximum of 24 hours. If a booking is not answered within 24 hours, ServiceHelper is free to offer it to other
Freelancers. By repeatedly exceeding the deadline, Freelancer can be excluded from the platform.
§ 2.4 Freelancer must inform his customer of cancellation as soon as possible and at
least
24 hours before a task, if Freelancer is ill or otherwise prevented from performing the task.
§ 2.5 If, at the request of a freelancer or customer, a change is made to a booking less
than 24 hours before execution, this change can only be made by ServiceHelper’s support. Therefore, in this case,
either the customer or the Freelancer should make sure to contact support.
§ 2.6 Freelancer decides when they want to work. And the working hours can thus vary
from
week to week according to the agreements Freelancer makes.
§ 3. Payment
§ 3.1 Freelancer determines his own hourly rate, within the prescribed limit.
§ 3.2 Users of the platform must pay for the provision of service via the platform.
Payment
or settlement is not allowed in any way directly between Freelancer and the customer.
§ 3.3 Service Helper charges service fee to mediate contact between customer and
Freelancer. This service fee currently is between 10% and 20% and paid by customer.
§ 3.4 Payment is due no later than the third working day after the end of the month.
Payment is made to the bank account on Freelancers profile on the platform. The payout period is from the 25th to
the 24th of each month.
§ 3.5 Freelancer is obliged under Danish law to report remuneration as B-income to the
tax
authorities. If Freelancer has earned more than 50,000 for 12 consecutive months, Freelancer is required to notify
ServiceHelper and register for VAT.
§ 4. Cost
§ 4.1 All costs associated with the performance of service tasks – including travel
costs,
work clothes, safety equipment, accommodation and the like – are borne by freelancers.
§ 4.2 If a freelancer offers to include rental items, it is initially the Freelancer who
pays the rental price. This is reimbursed together with payment for performing the task.
§ 5. Other tasks
§ 5.1 Freelancer is free to take on other tasks.
§ 6. Privacy
§ 6.1 Freelancer may not unauthorized disclose, use, or enable others to use,
ServiceHelper information of any kind that is not publicly available.
§ 6.2 The provision described in § 6.1 also applies when the collaboration is
interrupted.
§ 7. Duration
§ 7.1 Service Helper may withdraw Freelancer’s approval at any time without notice and
terminate this cooperation agreement.
§ 7.2 Freelancer can terminate this collaboration agreement and dissolve profile on the
platform up to 24 hours before a booked agreement with a user.
§ 8. Other Terms
§ 8.1 Only the booked Freelancer is allowed to perform the booked tasks. No substitute
may
be sent, even in the event of illness, unless this has been agreed in writing with the Service Helper in advance.
For Freelancers registered as a company, however, it is permissible to send employees of your choice.
§ 8.2 The provision described in § 8.1 does not apply to freelancers offering Senior
Aid.
Here are extra strict requirements for the Freelancer who shows up for the booking.
§ 8.3 If you state in your profile that you can also provide visited services, you also
accept the separate business conditions associated with offering this service through our portal – including that
a
power of attorney is given so that we can send an invoice to the municipality on your behalf and your acceptance
of
our service fee to handle these types of transactions.
§ 8.4 The employment relationship is not governed by collective agreements. Service
helper
is not an employer for Freelancer, but merely mediates contact between customers and Freelancer.
§ 8.5 If a dispute arises between Freelancer and Service Helper, which cannot be resolved
bilaterally, the dispute must be submitted to the Copenhagen City Court.
